Terms of service

This page is a plain-language draft written by the Back At It team. It has not yet been reviewed by a lawyer. We are publishing it because being clear with you now beats saying nothing, and we will update it once counsel has been through it.

These terms are the agreement between you and Back At It ("Back At It", "we", "us"). By creating an account or using the app you agree to them. If you do not agree, please do not use the service.

What Back At It is

Back At It is a fitness and wellness app: workout plans, nutrition and habit tracking, calculators, and a place to record your own health information. It is education and encouragement, not healthcare. Please read the medical disclaimer, which forms part of these terms.

Who can use it

You must be 21 or older to create an account. We do not knowingly collect information from anyone under 18 under any circumstances. If we learn an account holder is under 21, we will close the account and delete the data.

Your account

  • Keep your login details to yourself. You are responsible for what happens on your account.
  • Give us accurate information. The app's estimates are only as good as what you enter.
  • Tell us promptly if you think someone else has got into your account.

Membership, billing and cancellation

Paid memberships are billed through Stripe on a recurring basis at the price and interval shown at checkout. Your membership renews automatically until you cancel. You can cancel any time from your account, and the cancellation takes effect at the end of the period you have already paid for. See our refund policy for how refunds work.

Assumption of risk

Exercise and changes to how you eat carry a real risk of injury or illness. You take part voluntarily and at your own risk. You confirm that you are in a fit state to exercise, and that you have checked with a doctor if there is any reason to think otherwise. Stop and get medical help if something feels wrong.

What we do not promise

The service is provided as it is. We do not promise that any target, estimate or plan is accurate for you, that the app will be uninterrupted or error free, or that you will get any particular result. Third-party information in the app, including exercise data, recipe data and nutrition data, comes from outside sources and may be incomplete or wrong.

Limitation of liability

To the fullest extent the law allows, Back At It and its owners are not liable for any injury, illness, loss or damage arising from your use of the service, including anything indirect or consequential. Where liability cannot be excluded, our total liability to you is limited to the amount you paid us in the twelve months before the claim.

Your content

Your journal entries, photos and logs stay yours. You give us only the permission we need to store and display them back to you, and to show them to other people when you choose to share them through a social feature. We do not sell your content and we do not use your health data for advertising.

Acceptable use

  • Do not use the app to harass, threaten or impersonate anyone.
  • Do not post content that is unlawful, or that you do not have the right to post.
  • Do not try to break, scrape or overload the service, or get at other people's data.
  • Do not present anything from the app as medical advice to anyone else.

Ending your membership

You can close your account at any time from your account settings. We may suspend or close an account that breaks these terms, or where we have to for legal or safety reasons. Deleting your account removes your data as described in the privacy policy.

Changes

We may update these terms. We will change the date at the top of this page, and for anything significant we will tell you in the app or by email before it takes effect.

Governing law

These terms are governed by the laws of the State of Texas, USA, and the courts of Texas have jurisdiction over any dispute.
